Following the counter-attack by Elon Musk who filed a complaint against Twitter, the social network rejects his claims and declares that they are “implausible and contrary to the facts”. The legal battle intensifies.
Elon Musk decided to counterattack last week. In July, Twitter filed a complaint against Elon Musk with the Delaware Court of Chancery, a US business court, for breach of acquisition contract. The American billionaire has effectively given up his takeover of Twitter for 44 billion dollars. From now on, Elon Musk also filed a lawsuit against Twitter who would not have provided him with the necessary information on the social network’s fake accounts and spam accounts.
According to Elon Musk, the information shared by Twitter is not sufficient to verify that less than 5% of over 220 million daily users of the platform are fake accounts or spam accounts. The businessman even claims that Twitter has distorted or omitted information that could have revealed the value of the company.
According to Twitter, Elon Musk finds excuses to give up the takeover of the social network
Following this complaint from Elon Musk, Twitter decided to respond with a 127-page legal document. This document was shared publicly yesterday. The bluebird social network qualifies Elon Musk’s claims as ” implausible and contrary to the facts “.
The legal document details in particular that: when Twitter filed a lawsuit to enforce his rights and exposed the weakness of those reasons, Musk spent weeks finding more speculative reasons – the counterclaims – that offer a whole new set of excuses for his violation . Counterclaims are a story made for litigation that is contradicted by evidence and common sense “.
The legal battle between Twitter and Elon Musk is therefore intensifying ahead of the trial. As a reminder, Twitter has already won a first victory against Elon Musk regarding the date of the trial. While the American billionaire wanted to postpone the lawsuit to February 2023, Twitter succeeded in winning his case by asking that the lawsuit be sent as quickly as possible. It will actually be held on October 17, 2022 if the two parties cannot reach an agreement before this date.
